  2. This is why we need to move "fair use" into the absolute justification category. Right now? It's considered an affirmative defense. If it was considered an absolute justification? The company would have the burden of proof which is how it SHOULD BE because they are the ones accusing you of committing whatever they want to accuse you of. You are always innocent until proven guilty. Fair use is a legitimate thing and without it? ANY company (not strictly talking about S.E.) could decide to screw you for literally anything. Complain about the game during a stream? You get sued. Don't like the characters? YOU get sued. You understand? Any company could be very malicious without fair use laws in place and these are needed to protect content creators and gamers all the time.

  4. I've honestly broken a couple of these, namely either using music from Monster Hunter in my FFXIV videos, or in general using FFXIV music from the orchestrion and having it play over the top of gameplay. (I mostly do solo challenge content)
    Thing is I've never gotten "struck", although I've gotten a few claims. Though that being said I'm a tiny channel and get anywhere between a couple hundred to a couple thousand views at most so I don't think they care so long as I'm not changing the actual material or trying to redistribute it in some way as is more explicitly stated in those guidelines which is why it just gets claimed instead. I've got no intention to really gain a tonne of views or monetise it in any way, but regardless I will probably avoid at least using MH music in FF videos. Only reason I did that to begin with was the crossover of viewers.

  5. My old channel got a strike for the opening cinematic of 1.0 as part of a let's play. They rejected my counter that it was fair use and that strike remained until like 2 years ago when Square-Enix suddenly and mysteriously released it like 8 years after it was issued and I had long abandoned the channel.

  6. I will never understand legal jargon, so it's probably best I'm not a content creator. Lol I have one question, if Footfalls was ultimately put on the safe list, and your video is safe now, why did the strike still remain? Anyways, glad your channel wasn't removed. I enjoy your lyric videos! Especially the Nier/FFXIV ones. That said, can you still create lyric videos, or is the end of making them?

  7. The official Endwalker soundtrack comes out 2/23 and then they'll update their soundtrack list most likely with that soundtrack when it's officially released.
    I've seen many creators post up songs to see them disappear after a few days most likely due to copyright strikes. It even happened with the new raid music day one. I wouldn't put up any new songs until they update that list of soundtracks to be safe.
    I'm glad you were able to get your channel back up and running.
